Acceptable Use Policy

This Acceptable Use Policy (“AUP”) governs Customer’s access to and use of the Services. Capitalized terms not defined herein have the meanings given to them in the Definitions section (or Definitions page), as applicable.
By accessing or using the Services, you agree to comply with this AUP.
1. Purpose
The Services are intended for lawful business purposes consistent with the Underlying Agreement. This AUP is designed to protect PostGrid, its customers, end users, carriers, vendors, and the public from misuse, abuse, fraud, and unlawful activity.
2. Prohibited Conduct
You may not use the Services to:
- Violate any applicable law, regulation, or governmental order.
- Infringe or misappropriate the intellectual property or other rights of any third party.
- Transmit, distribute, or facilitate fraudulent, deceptive, or misleading content.
- Harass, threaten, defame, abuse, or intimidate individuals.
- Promote violence, illegal activity, or unlawful discrimination.
- Submit false, inaccurate, or misleading information.
- Circumvent usage limits, rate limits, or security controls.
- Interfere with or disrupt the integrity or performance of the Services.
3. Direct Mail and Communications
If you use the Services to send mail or other communications, you are solely responsible for ensuring that your communications comply with applicable postal, marketing, and consumer protection laws.
You must maintain a valid legal basis for using recipient data, honor opt-out and suppression requests as required by law, and ensure that communications are not fraudulent, misleading, or unlawful. You remain responsible for proper classification of mail and compliance with applicable carrier requirements.
The Services may not be used to impersonate another person or organization or to engage in deceptive mailing practices.
4. Fair Use and System Integrity
You may not use the Services in a manner that:
- Generates excessive automated traffic that degrades performance.
- Attempts to reverse engineer, probe, scan, or test system vulnerabilities.
- Introduces malware, malicious code, or harmful scripts.
- Attempts to bypass API authentication, authorization, or usage controls.
PostGrid may take action to address activity that materially degrades system performance or threatens the integrity of the Services.
5. Data Protection and Privacy
You are solely responsible for ensuring that your use of the Services complies with applicable data protection and privacy laws, including GDPR, CCPA, PIPEDA, and other applicable laws.
If you process Personal Information using the Services, you represent and warrant that:
- You have obtained all necessary consents or legal authorizations.
- You maintain reasonable administrative, technical, and organizational safeguards to protect Personal Information.
- You will honor individual rights requests as required by law.
- You will not use the Services for unlawful tracking, surveillance, or monitoring of individuals.
- Where required by applicable law, you will enter into a data processing agreement with PostGrid.
Data Breach Notification
If you become aware of unauthorized access to or compromise of Personal Information processed through the Services, you must notify PostGrid without undue delay at security@postgrid.com and reasonably cooperate with any investigation.
Prohibited Data
You may not use the Services to process:
- Special categories of Personal Information (such as health or biometric data) unless expressly permitted under an executed agreement with PostGrid.
- Personal Information of children under 13 without appropriate legal authorization.
- Data in a manner that would subject PostGrid to regulatory obligations it has not agreed to undertake.
6. Regulated Industry Compliance
Certain industries are subject to heightened legal and regulatory requirements. If you use the Services in connection with regulated industries (including healthcare, financial services, insurance, debt collection, cannabis, or other restricted industries), you are solely responsible for ensuring that your use of the Services complies with all applicable laws, regulations, licensing requirements, and industry standards. Without limiting the foregoing:
PostGrid reserves the right to request reasonable documentation demonstrating regulatory compliance and may suspend or terminate Services where it reasonably determines that continued provision of the Services presents regulatory, legal, or reputational risk.
7. Account and Credential Security
You are responsible for maintaining reasonable security precautions for your account and credentials. This includes protecting login credentials and API keys from unauthorized disclosure, limiting access to authorized personnel, and promptly revoking or regenerating compromised credentials.
If you integrate the Services with third-party systems, you are responsible for ensuring that such integrations do not compromise the security of the Services.
PostGrid is not responsible for unauthorized access resulting from your failure to maintain appropriate security controls.
8. Monitoring and Investigation
PostGrid reserves the right, but not the obligation unless and as required by applicable law, to monitor use of the Services to ensure compliance with this AUP and applicable law.
We may use automated or manual techniques to detect violations, identify security threats, protect system resources, respond to valid legal process, or protect the rights, property, or safety of PostGrid, its users, or the public.
PostGrid may access, preserve, or disclose account information or data where reasonably necessary to comply with applicable law, respond to valid legal process, enforce this AUP or the Underlying Agreement, or protect rights or safety.
We are not obligated to proactively monitor all activity. Our monitoring or failure to monitor does not constitute endorsement or approval of user activity.
9. Law Enforcement Cooperation
PostGrid may report suspected illegal activity to appropriate authorities and may preserve account information or data as necessary to comply with applicable legal requirements or pursue remedies.
10. Enforcement
If we determine that you have violated this AUP, we may take appropriate action consistent with the Underlying Agreement, including issuing warnings, suspending or restricting access, refusing to process certain transactions, or terminating your account.
Enforcement decisions are made in our reasonable discretion and remain subject to the governing Underlying Agreement.
11. Reporting Violations
If you become aware of misuse of the Services or a violation of this AUP, you may report it to security@postgrid.com.
12. Reservation of Rights
Nothing in this AUP limits PostGrid’s rights or remedies under the Underlying Agreement or applicable law. We reserve all rights and remedies available to us in response to violations of this AUP.
